Burglary In The Second Degree
In the present case, the defendant shattered a window of a Ballard business under construction. While inside, he staged tools near the exit to steal at a later time. Post-Miranda, he admitted to breaking into the business. King County Prosecutors argued for the defendant to be held on $5,000 bail. The pro tem first appearance judge released the defendant on his personal recognizance, over the objection of prosecutors.

Violation of the Uniform Controlled Substances Act (possession with intent — fentanyl)
In the present case, the defendant was observed selling pills near 3rd Avenue and Pike Street in downtown Seattle believed to be laced with fentanyl. In the search incident to arrest, the defendant had $50 cash on him, addition to several “blues.” The defendant’s criminal history includes convictions for Assault 3-DV (2019), Malicious Mischief (2021), Robbery 1 (2021), Assault 4-DV (2020), VNCO (2019), and Obstruction (2020).

Retail Theft With Special Circumstances in the Third Degree
On September 14, 2022, the defendant shoplifted merchandise worth over $400 from Target and exited the business with the stolen merchandise through a designated emergency exit. To access the emergency exit, the defendant had to enter an employee only area. To exit through the emergency doors the defendant had to push heavy steal fire doors with large bright red signs that indicate the exit is for emergencies only, and push panic bars with audible alarms. Police arrested the defendant on the sidewalk near the store. The defendant was still in possession of the stolen items. Per court records, the defendant has a history of at least 17 warrants for failure to appear since 2017. At the time of filing, the defendant had five active warrants for failure to appear. The defendant’s active warrants are from Bothell Municipal Court (2022), Snohomish County-Everett Division (2021), Lynwood Municipal Court (2020, 2020), and King County District Court (2022). Given the defendant’s lengthy and recent warrant history for failing to appear, the KCPAO asked the court to hold him on $5,000 bail.
